These General Terms and Conditions of Sale are applicable between Quality Spa, SARL with share capital of €100,000, whose registered office is located at 14 avenue des Vignes, 17320 Saint-Just-Luzac, France, registered in the trade and companies register of La Rochelle under number 832359137, Intra-community VAT number: FR21832359137, hereinafter referred to as “Quality Spa”, and ANY PERSON, natural or legal, contracting with Quality Spa for the order of Products, hereinafter referred to as “the Customer”.
“Site Content”: elements of any nature published on the Site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases or software.
“Internet user”: any person, natural or legal, private or public, connecting to the Site.
“Site”: website accessible at the URL www.qualityspa.fr , as well as the sub-sites, mirror sites, portals and URL variations relating thereto.
“Order form”: contractual document containing the characteristics of the Customer’s order.
“Quote”: contractual document containing the specific, technical and pricing conditions of the Customer’s order for a Custom Product.
“Product”: goods marketed by Quality Spa, including Custom Products, and in particular spas and their accessories.
“Custom Product”: Personalized product subject to a Quote at the request of the Customer.
“Current Price”: provisions of this contract determining the price and delivery costs of each Product, excluding Custom Products.
The Site is freely accessible to all Internet users. Browsing the Site implies acceptance by all Internet users of these general conditions. Simply connecting to the Site, by any means whatsoever, including through a robot or a browser, will imply full and complete acceptance of these general conditions. When registering on the Site, this acceptance will be confirmed by checking the corresponding box.
The Internet user also acknowledges having fully understood them and accepts them without restriction.
Checking the above box will be deemed to have the same value as a handwritten signature from the Internet user. The Internet user acknowledges the evidentiary value of Quality Spa's automatic recording systems and, unless he provides proof to the contrary, he waives the right to contest them in the event of a dispute.
These general conditions apply to the relations between the parties to the exclusion of all other conditions, and in particular those of the Internet user.
Acceptance of these general conditions assumes that Internet users have the necessary legal capacity to do so, or failing that, that they have the authorization of a guardian or curator if they are incapable, of their legal representative if they are minors, or that they hold a mandate if they are acting on behalf of a legal entity.
4.1. Purpose of the company:
Quality Spa is a French designer of Spas and Swim Spas.
4.2. Specificity of the Site and the company:
Quality Spa offers hot tubs, swim spas and saunas to individuals, as well as all types of accessories related to these elements.
5.1 Conclusion of the contract
The issuance of a quote by the Customer is firm and irrevocable. The Customer is immediately bound by his order and cannot cancel it. The contract is formed upon acceptance of the quote by Quality Spa.
The Customer may send the Quote or Order Form by email or post. In the event of electronic transmission, the production of a copy of the electronic correspondence by Quality Spa will constitute proof of the existence of the contract, unless proven otherwise by the Customer.
Quality Spa will then proceed with the delivery of the ordered products according to the deadline confirmed to the customer. In the event of a delay in delivery beyond the control of Quality Spa, in particular due to logistical, maritime or land constraints, no refund or compensation may be demanded by the customer until the maximum deadline of 32 weeks has been exceeded.
5.2 Ordering terms
To order or inquire about Products, the Customer can use the various means below:

In order to reserve the current offer, a reservation fee will be required; this amount will not commit the production of the spa.
The Customer has the possibility to check the details of his order and its total price, and to correct any errors, before confirming it.
Quality Spa will confirm receipt of the Customer's order.

5.3 Validation of the order
In order to validate the order, a deposit will be requested for the production of the Product.
The order will only be confirmed after receipt of this payment. The delivery time will begin from this date.
As a security measure for its users and to protect against fraud attempts, Quality Spa reserves the right to verify with the relevant organizations the validity of payments made by any user. Furthermore, Quality Spa reserves the right to request or even demand additional information, or to request a change in the payment method for orders.
These security measures demonstrate Quality Spa's commitment to protecting its users against possible fraud attempts.
5.4 Availability
Product offers are subject to availability and are normally dispatched within 48 hours.
For Products not stocked in Quality Spa warehouses, offers are valid subject to availability from suppliers.
In the event of unavailability of certain products, Quality Spa undertakes to inform its Customers by email or telephone within a maximum of 30 days from the date of placing the order and to inform them of the delivery time. In the event of temporary unavailability of certain Products, Quality Spa will ship available Products of equivalent quality and price to the order placed by the Customer. In this case, in the event of withdrawal, the Customer will not have to pay any return costs.
6.1 Price
The applicable prices are those displayed on the Site and/or the Quote on the day of the order. These prices may be modified at any time by Quality Spa for any subsequent order. The prices displayed are only valid on the day of the order and do not have effect for the future.
The prices indicated on the Site are in euros, all taxes included, excluding delivery costs.
6.2 Payment method
The Customer can pay by check, card, or bank transfer. Payments by credit card are made using secure transactions provided by Crédit Agricole.
When paying by credit card, Quality Spa does not have access to any data relating to the Customer's payment methods. Payment is made directly to the bank.
In the event of payment by check or bank transfer, delivery times only begin to run from the date of receipt of payment by Quality Spa.
Payments by check must be accompanied by the Quote and sent to Quality Spa.
6.3 Billing
Quality Spa will send or make available to the Customer an invoice electronically after each payment. The Customer expressly agrees to receive invoices electronically.
6.4 Default of payment
Agreed payment dates cannot be delayed for any reason whatsoever, including in the event of a dispute.
Any amount not paid on the due date will automatically and without formal notice give rise to the application of late payment penalties calculated on the basis of a rate equal to 3 times the legal interest rate, without this penalty affecting the due date of the principal amounts due. In addition, any late payment will result in the defaulting professional Client being invoiced for recovery costs of 40 euros per invoice due and all amounts remaining due becoming immediately due regardless of the agreed deadlines, plus compensation of 20% of the amount as a penalty clause. In any event, any late payment will result in the possibility of unilaterally terminating the contract to the detriment of the Client. This clause is in accordance with the provisions of Article 1152 of the Civil Code, which allows the judge to reduce the compensation if the judge considers it to be excessive.
6.5 Payment on delivery
Any payment referred to as “upon delivery” will be made at the time of arranging the delivery of the Product in order to set a date, ensure proper organization, and avoid the delivery of an unpaid Product to the Customer. In the event of refusal of payment or inability to pay before the deadline, the delivery will be canceled, and the carrier will contact the Customer for a new appointment. New shipping costs will be charged to the Customer. The minimum amount of these costs is €500 including tax for 2 to 6-seater Spas, €750 including tax for 7 to 8-seater Spas and €1000 including tax for Swim Spas.
6.6. Storage costs
Storage costs of €80 including tax per month for a massage spa and €120 including tax per month for a swim spa are implemented if the Customer wishes to delay the delivery date by more than 1 month based on the time initially indicated on the Quote.
This invoice is established in advance on the first day of the month triggering the invoice. Storage fees are immediately implemented as soon as a delivery planned and agreed by the Customer is subject to cancellation on their part. From then on, each day of storage will be invoiced at the rate of €15 excluding VAT, the total amount depending on the number of days, will be charged to the remaining amount due on the order. Storage fees of €8 per day will be applicable if the Customer has still not paid for and collected their order at the end of the 6 months from the validation of the order.
6.7 Retention of title
The Products sold remain the property of Quality Spa until full payment of their price, in accordance with this retention of title clause.
7.1 Customer Service
The Site's customer service is available by telephone at 05.17.25.81.39 from Tuesday to Friday from 10 a.m. to 1 p.m. and from 2 p.m. to 7 p.m., Saturday from 10 a.m. to 6 p.m., by email at: contact@qualityspa.fr or by post to the address indicated in Article 1 of these general conditions. In the latter two cases, Quality Spa undertakes to provide a response within 10 working days.
7.2 Right of withdrawal – Distance selling
This article applies to the Customer having the status of consumer within the meaning of the introductory article of the Consumer Code and to the professional Customer benefiting from the protection referred to in article L. 221-3 of the same code.
7.2.1. Conditions for exercising the right of withdrawal
In accordance with current legislation on distance selling, the Customer has a period of fourteen clear days to exercise his right of withdrawal without having to provide reasons or pay penalties, with the exception, where applicable, of return costs.
The period referred to in the preceding paragraph runs from either the day on which the distance contract is concluded for contracts relating to the provision of a service and/or the provision of digital content not provided on a physical medium, or from the receipt of the goods by the Customer or a third party, other than the carrier, designated by him, for contracts for the sale of goods and contracts for the provision of services including the delivery of goods.
In the case of an order for several goods delivered separately or in the case of an order for a good composed of multiple batches or parts whose delivery is staggered over a defined period, the period runs from the receipt of the last good or batch or the last part. For contracts providing for the regular delivery of goods over a defined period, the period runs from the receipt of the first good.
When the fourteen-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
The decision to withdraw must be notified to Quality Spa at the contact details indicated in Article 1 of these general terms and conditions by means of an unambiguous statement. The Customer may, for example, use the standard form provided at the end of these general terms and conditions. In any event, Quality Spa will send the Customer an acknowledgement of receipt of said withdrawal by email as soon as possible.
7.2.2 Effects of the right of withdrawal
The Customer returns or restores the products to the professional or to any person designated by the latter, without undue delay and, at the latest, within fourteen days following communication of his decision to withdraw.
When the right of withdrawal is exercised, the professional is required to reimburse the Customer for all sums paid, as soon as possible and at the latest within fourteen days following the date on which this right was exercised. Where applicable, the professional may defer reimbursement until recovery of the Products or until the Customer has provided proof of shipment of the Products, whichever is the earlier. Beyond this, the amount due is, by operation of law, productive of interest at the legal rate in force, as specified in Article L. 242-4 of the Consumer Code.
Where applicable, the professional will make the reimbursement using the same means of payment as that used by the Customer for the initial transaction, unless the Customer expressly agrees to the use of another means of payment and provided that the reimbursement does not incur any costs for the Customer. However, the professional is not required to reimburse additional costs if the Customer has expressly chosen a more expensive delivery method than the standard delivery method offered.
The direct costs of returning the Product are the responsibility of the Customer. These costs are estimated at a range between 7 and 120 euros, it being understood that the price of returning the Product may naturally vary depending on the weight, volume and number of Products returned.
The Customer is only liable for any depreciation of the Product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product.
The conditions, time limits and procedures for exercising the right of withdrawal are set out in the standard form provided at the end of these general conditions.
7.2.3 Exclusions from the right of withdrawal
The right of withdrawal does not apply, in particular, to contracts:
– the provision of services fully performed before the end of the withdrawal period and the performance of which began after the express prior agreement of the Customer and express waiver of his right of withdrawal;
– supply of goods made according to the Client’s specifications or clearly personalized such as Spas in specific colors requiring a specific order, or custom-made saunas or pergolas.
– the supply of goods which, after being delivered and by their nature, are inseparably mixed with other items.
Similarly, the right of withdrawal is not applicable to contracts executed in full by both parties at the express request of the Customer before the latter exercises his right of withdrawal.
When confirming the order for a service, the Customer's waiver of the right of withdrawal will be demonstrated by checking the box corresponding to the following sentence: "I expressly waive my 14-day right of withdrawal for services from which I benefit before the end of this period." The Customer will then receive confirmation by email of their waiver of the right of withdrawal.
The Customer who has exercised his right of withdrawal from a service provision contract, the execution of which has begun, at his express request, before the end of the withdrawal period, pays the professional an amount corresponding to the service provided until the communication of his decision to withdraw, this amount being proportional to the total price of the service agreed in the contract.
7.3 Termination of the contract at the initiative of the Client
The Consumer Customer may cancel the contract by registered letter with acknowledgement of receipt if the delivery date of the goods is exceeded by more than seven days. The Customer will then be reimbursed for the amounts paid by him when ordering.
This clause shall not apply if the delay in delivery is due to a case of force majeure. In such a case, the Customer undertakes not to take legal action against Quality Spa and waives the right to invoke the cancellation of the sale provided for in this article.
7.4 Guarantees
7.4.1 Warranty for apparent defects and faults
It is the Customer's responsibility to check that the Products are in good condition at the time of delivery. This check must include, in particular, the quality, quantities and references of the Products as well as their conformity with the order. No complaints will be considered after a period of three days from delivery. In any event, any complaints concerning delivered packages will only be taken into account if the Customer, who is a trader, has expressed reservations to the carrier in accordance with Articles L. 133-3 et seq. of the French Commercial Code.
7.4.2 Warranty for hidden defects and faults 7.4.2.1 Legal guarantees
Customers have a legal guarantee of delivery in accordance with the terms of the contract (Article 1604 of the Civil Code), a legal guarantee against hidden defects (Articles 1641 et seq. of the Civil Code) and a security guarantee (Articles 1245 et seq. of the Civil Code).
Customers with consumer status also have a legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code).
7.4.2.2 Conventional guarantee
The Products benefit, in addition to the legal guarantee, from a conventional guarantee of conformity on French territory.
1. Conditions for benefiting from the conventional guarantee
In order to benefit from the conventional guarantee, the Customer undertakes:
For Spas:
– Use treatment products referenced by Quality Spa
– Use the original Quality Spa filters and change them at least once a quarter for special use.
– Do not place PVC panels in contact with the ground or expose them to excessive sunlight.
– Clean the tarpaulin outdoors at least once a month
– Take a shower before entering the spa
– Do not use your spa with greasy products on your body
– Do not use your spa with long hair loose
– Do not sit on the edge of your spa or on the valves, headrests or control box
– Do not jump into your spa
– Do not obstruct the jets with any object or accessory
– Do not clean your spa with an abrasive product
– Do not clean your spa with an abrasive product
– Do not tighten the valves forcefully
– Do not stand in front of the skimmer or suction nozzles
– Do not embed or bury your spa without leaving access and water drainage (50 cm minimum). Travel or lifting costs will be charged to the customer for any intervention.
If the customer makes a specific arrangement to highlight their wellness area, we will send them all the information necessary to best install their Spa. However, in the event of intervention or change of Spa, Quality Spa will not cover the costs necessary for the recovery of the Spa. The customer is responsible for the arrangement around their Spa and takes full responsibility for it.
For Saunas:
- Call a professional electrician to connect the sauna and the electric stove if they have one.
- Leave 1 cm between the wooden wall and the wall so that the sides can breathe.
- Do not exceed a maximum continuous use of one hour and do not use it for professional purposes if the product does not bear the name.
- Do not pour water carelessly or in too large a quantity onto the stones, as this could affect the proper functioning of the resistors.
- Do not install the Sauna in a garage, or a damp room, if the product is an indoor sauna.
- Do not leave towels or cloths on the stove.
- Do not spend more than 20 minutes in the sauna.
- Do not raise the temperature above 90°C.
- Do not use the Sauna under the following conditions:
To people suffering from infectious diseases
After an intensive sports session
With open wounds
Eye disease
Severe sunburn
Under the influence of alcohol, illicit substances, or medication before or during use is likely to cause loss of consciousness.
Sauna is strongly discouraged:
To pregnant women
To children under 18 years old
For people suffering from obesity or with a history of heart disease, high or low blood pressure, circulatory problems or diabetes.
To people undergoing medical treatment
If in doubt, please consult your doctor.
Leave immediately if you feel uncomfortable, dizzy, or drowsy. Staying in a hot place for too long can cause discomfort.
Quality Spa disclaims all liability for failure to comply with the above safety instructions. It is the responsibility of each user to strictly follow these recommendations to ensure their safety and well-being when using the sauna. In the event of non-compliance with these rules, Quality Spa declines all liability in the event of an accident or damage.
For Pergolas:
- Have a perfectly level floor type: Composite, concrete, tile.
Wooden decks wear and tear over time and are subject to moisture, which can damage equipment such as curtains, windows, or shutters. This will prevent you from properly closing or sliding your decks in the near future. No warranty will cover any issues caused by inadequate flooring or support.
- Securely fix the Pergola to the ground
- Connect your pergola to a compliant electrical supply, carried out by a professional electrician. Ensure all connections are perfectly watertight.
2. Terms of application of guarantees
As a mere distributor, Quality Spa cannot provide any contractual warranty relating to the Products. The warranties applicable to the Products are the manufacturer's and manufacturer's warranties. Quality Spa cannot be held liable for any compensation to the Customer for any consequences arising from the misuse of the equipment as well as leaks or micro-leaks even if the Customer subscribes to any kind of extended warranty.
3. Maintenance:
Quality Spa approved products have been tested for many years and help preserve the Product. The use of any other product may result in damage and the immediate cancellation of the Customer's warranty.
Frequency for one year regarding Spas:
– 1 maintenance kit per year (chlorine or bromine, PH+ and PH-) + 2 x Chlorine, Bromine or Active Oxygen Containers + 2 filter changes
Defects and leaks:
The spa is tested in Quality Spa's warehouses before delivery, with 50 control points during a conformity test. The Customer has 14 days to fill the spa with water and contact customer service if any defects or leaks appear. After this period, the technician's travel costs will be borne by the Customer.
Connection:
The spa or sauna must always be connected to the Customer's electrical panel by a professional. An invoice may be required.
4. Manufacturer's warranties
The manufacturer's guarantees are as follows:
Saunas: 1 year on the structure, 2 years on the electronics.
Custom-made thermal blanket: 1 year for any manufacturing defect.
For Pergolas:
A 10-year structural warranty for the Nova range and 15 years for the Alto and Signature ranges, taking into account proven and impactful deformation of the structural element.
Engine: 3 years
Any manufacturing defect or premature wear of the product.
LEDs: 2 years
Any manufacturing defect or premature wear of the product.
AkzoNobel paint: 5 years
Any manufacturing defect
For spas:
Sales to professionals:
2-year parts warranty on pumps and electronics
10-year parts warranty on tank** and structure*
Sales to individuals:
As part of the Essential or Comfort series warranty, 2-year warranty.
The Customer is entitled to assistance via email from a Quality Spa after-sales service technician in this procedure. If the Customer has a debit account and has not paid for previous services, the guarantee will not be maintained until the amounts due are received.
As part of the Intense Series 3-year warranty, the Customer is entitled to assistance via email from a Quality Spa after-sales service technician in this procedure.
If the customer has a debit account and has not paid for previous services, the guarantee will not be maintained until the amounts due are received.
10-year parts warranty: Tank** and Structure* for the Essential or Comfort series
20-year warranty on parts and labor: Tank** and Structure* for the Intense series
2-year parts warranty: Pumps, Blower, Filtration for the Essential or Comfort series
3-year warranty on parts and labor: Pumps, Blower, Filtration for the Intense series
2-year parts warranty: control box and central unit for the Essential or Comfort series
3-year parts and labor warranty: control box and central unit for the Intense series
The Intense warranty includes labor for the following cases:
– replacement of the central unit.
– replacement of the waterfall.
– replacement of pumps (filtration, pressure, blower).
– replacement of the chromotherapy system.
– replacement of the Spa’s interior aromatherapy system.
– replacement of the Spa’s internal control valve bodies.
If the Customer requests a technician to travel outside of these elements, they will be billed for the travel fee as well as the hours of labor.
For all Essential, Comfort or Intense series, 1 year parts warranty:
Cladding (wood, PVC) + all pool accessories (nozzles, diverter lever, suction grid, aromatherapy plug, chromatherapy LEDs, waterfall, drainage system, etc.).
Labor is charged at €80 including tax per hour for interventions not covered by the so-called “parts” guarantees, and not listed above.
This guarantee is only valid in France, Corsica or DROM-COM.
*Structural Warranty: Quality Spa warrants the structure of its spas against water loss due to a failure of the frame structure for a period of 5, 10 or 20 years, depending on the spa series, from the date of purchase. If the expert appraisal proves that the frame is defective, Quality Spa will repair or replace it.
**Tank Warranty: Quality Spa guarantees the watertightness of its pools against all manufacturing defects for a period of 5, 10 or 20 years depending on the spa series, starting from the invoice date. If the expert appraisal proves that the pool shell is leaking and not watertight, Quality Spa will repair or replace it. Cracks, osmosis or impacts on the shell are not covered by this warranty.
Electronics and pumps warranty: Quality Spa guarantees the equipment of its Spas, such as pumps, blower, heater, management system and electronic control against any defect or malfunction for a period of 2 or 3 years depending on the Spa series from the date of purchase.
1-year warranty on cabinet and accessories: Quality Spa guarantees the cabinet of the Spa against any defects in materials or manufacturing on the invoice date of the Spa. The cabinets are treated against UV rays, but this only slows down the aging of the accessories such as nozzles, handles, suction grilles, internal aromatherapy system, or consumables, speakers, LED system.
Osmosis Warranty: Under the osmosis warranty indicated on the customer's invoice, Quality Spa will replace the spa with a new one provided that the osmosis case is significant and covers at least 30% of the shell surface. In the case of slight osmosis, this will not be covered.
WARRANTY LIMITATIONS
This limited warranty is void if the manufacturer or its designated representative determines that the spa has been subject to alteration, neglect, misuse or abuse, or damage caused by the carrier; repairs attempted by anyone other than a designated representative; or if the failure is caused by accident, acts of God, or other causes beyond the manufacturer's control.
Neglect and abuse include any installation, operation or maintenance of the spa except in accordance with the instructions contained in the owner's manual, including, but not limited to, failure to maintain proper water chemistry and the use of abrasive or improper cleaners.
This warranty does not provide coverage for any item attached or installed to the spa after the date of manufacture, or for access to any component for repair or replacement.
Spas used for commercial purposes are excluded from any coverage whatsoever. This warranty is limited to the original owner of the spa, installed at the original site. Any request to change the location of the spa must first be approved by Quality Spa.
For spas installed outdoors, it is the owner's responsibility to properly maintain it. Quality Spa is not responsible for any damage caused by, but not limited to, rodent and/or insect infestations. In the event of malfunction of any part of the equipment, the owner must completely drain the spa and blow out all lines. Quality Spa is not responsible for any damage caused by freezing. For indoor installations, install the spa on a non-porous surface with adequate drainage. Quality Spa will not be held responsible for any damage to flooring, carpeting, ceiling or walls, or personal property due to leaks or improper operation of the spa. Quality Spa does not provide a leak warranty on the products it sells.
LIMITATIONS
All warranty service must be performed by Quality Spa or its designated representative using parts authorized by Quality Spa.
No agent, reseller, distributor, service company or other party is authorized to change, modify or extend the terms of this limited warranty in any way.
WARNING
Quality Spa, its agents, or employees shall not be liable for any injury to any person or for any resulting damages. All indirect costs, including loss of use, chemicals, damages, or contingent liabilities arising from any alleged defect in the spa are specifically excluded. In no event shall Quality Spa be liable for any reason or cause beyond the amount paid for the product in question.
ACTS THAT INVALIDATE THE GUARANTEE
This warranty is void if Quality Spa determines that the spa has been subjected to modifications, installation or repair by anyone other than an authorized representative.
Also, if the spa has been subjected by the owner to abuse, neglect, improper installation or maintenance, or operations other than those in accordance with the instructions in the owner's manual, including but not limited to: damage to components caused by improper pH balance or other improperly performed water maintenance; failure to maintain and clean the filtration system; damage to components or the shell surface caused by use of the spa in water temperatures outside the range of 0°C (freezing) and 48°C (excessive heat); damage caused by improper electrical connection and/or installation performed in non-compliance with national and local codes, or by anyone other than a licensed professional electrician.
Damage caused by power surges or spikes, or damage caused by acts beyond the control of Quality Spa will void the warranty.
Any spa installed or moved from its original location to another location by anyone other than an authorized technician may invalidate the warranty.
Failure to follow pre-delivery installation instructions, failure to follow operating instructions in the owner's manual, or the use of water care chemicals not approved by Quality Spa may invalidate your warranty.
RESTRICTIONS
The warranty will be automatically void in the event of negligence, improper use, for example, professional use of the spa, modifications without the written permission of Quality Spa, repairs carried out by unauthorized personnel, incorrect electrical connections, or in the event of phenomena beyond the control of Quality Spa such as earthquakes, floods, lightning, fire, etc. Quality Spa spas are designed for domestic use only. Quality Spa business declines all liability in the event of professional use.
COMPONENTS NOT COVERED BY WARRANTY:
• Filters.
• Skimmer and other wear parts. (except if they present a defect when put into service).
• Pump and heater seals.

CONDITIONS FOR CANCELLATION OF THE CONTRACTUAL GUARANTEE
For standard or custom thermal blankets:
Scratches and wear to the cover, resulting from normal use.
Damage to the Velcro caused by lifting the thermal blanket without removing the Velcro at the flaps.
Torn seams caused by misuse
Polystyrene sagging due to weight placed on the cover or due to too much snow left on the cover.
Polystyrene broken due to misuse or weight of more than 25kg mounted on it.
Handle torn off by lifting the cover by a single handle or the entire weight of the cover being held by only one handle.
For Saunas:
Installed and placed outdoors or in a room that is too humid, such as a cellar, garage, etc.
Too intensive use of more than one hour per day if the term professional does not appear on the invoice.
Failure to comply with the safety rules and instructions set out in Article 7.4.2.2
For Spas:
• Scratches and wear to the hull resulting from normal use.
• Spa water temperatures outside the limits, i.e., not between 0°C and 40°C.
• Deterioration caused by an incorrect water level (too low, overflow, etc.). • Deterioration caused by extreme temperature variations (frost, heat, etc.). • Deterioration caused by accumulation of dirt, limescale and calcium.
• Deterioration caused by clogging of filters.
• Deterioration caused by the use of chemical cleaning products not authorized by Quality Spa
• Deterioration of the shell, headrests, control buttons, keyboard, yellowing, whitening and/or discoloration of the nozzles caused by an incorrect chemical balance of the water. (Excessive dosage of chlorine, bromine, PH minus or PH plus, acids and use of flocculating products)
• Deterioration caused by exposure to the sun.
• Damage caused by failure to follow the service instructions set out in the owner's manual
• Damage caused by improper electrical connection, voltage drops or spikes, or by using the spa at a voltage 10% lower or higher than the prescribed voltage range.
• Damage caused by mounting the spa on an unapproved surface.
Spas must always be covered when not in use.
5. Additional guarantees
Bronze Guarantee
After-sales service with email assistance 7 days a week. The Bronze warranty provides a full 3-year warranty on parts and labor for the Essential series and 4 years for the Intense series. Labor covered by the warranty includes: replacement of the Balboa or Gecko central unit, replacement of the aromatherapy system excluding consumables, replacement of the waterfall, replacement of the pumps (filtration, pressure, blower), replacement of the chromotherapy spotlight, internal replacement of the control valves. Return of defective parts covered by the warranty.
Money Guarantee
After-sales service: 5 days a week phone support and 7 days a week email support. The silver guarantee provides a full 3-year warranty on parts and labor for the Essential series and 4 years for the Intense series, as well as travel. Labor and travel covered by the silver guarantee include:

7.4.2.3. Return
In order to implement the warranty, it is the Customer's responsibility to return the Product to the Quality Spa headquarters address, accompanied by an explanatory letter requesting either repair, exchange or reimbursement.
The costs of returning the Product remain the responsibility of the Customer, except for consumer Customers implementing the conformity guarantee of articles L. 217-4 et seq. of the Consumer Code.
The Consumer Customer has a period of 2 years from delivery of the goods to take action against the seller. As such, he can choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code. Finally, the Customer is exempt from providing proof of the existence of the lack of conformity of the Product during the 24 months following delivery of said Product, except for used goods.
Where applicable, the legal guarantee of conformity applies independently of the commercial guarantee.
When the Consumer Customer decides to implement the hidden defects guarantee, he can choose between the cancellation of the sale or a reduction in the sale price.
8.1. Creation of personal space
The creation of a personal space is an essential prerequisite for any order by an Internet user on the Site. To this end, the Internet user will be asked to provide a certain amount of personal information. Some of this information is deemed essential for the creation of the personal space. The refusal by an Internet user to provide said information will have the effect of preventing the creation of the personal space as well as, incidentally, the validation of the order.
When creating the personal space, the Internet user is asked to choose a password.
This password guarantees the confidentiality of the information contained in the personal space. The Internet user is therefore prohibited from transmitting or communicating it to a third party. Otherwise, Quality Spa cannot be held responsible for unauthorized access to an Internet user's personal space.
The Client undertakes to regularly check the data concerning him/her and to make any necessary updates and modifications online, from his/her personal space.
8.2 Content of the personal space
8.2.1. General information
The personal space allows the Customer to consult and track all of their orders placed on the Site.
The pages relating to personal spaces are freely printable by the holder of the account in question, but do not constitute evidence admissible in court.
They are only for information purposes and are intended to ensure efficient management of orders by the Customer.
Quality Spa undertakes to securely store all contractual elements whose retention is required by law or regulations in force.
8.2.2. Customer Contributions
Customers are given the opportunity to contribute to the content of the Site by posting comments on their use of the Products and their relationship with Quality Spa. Comments must be provided in French. They will be subject to validation by Quality Spa or its team of moderators.
By clicking on the "Validate" tab, in order to publish their comment, the Client grants a non-exclusive, free copyright license to Quality Spa relating to said comment. As such, the Client authorizes Quality Spa to communicate to the public online, in whole or in part, their comment on the Site, Quality Spa newsletters and the sites of Quality Spa partners. The Client authorizes Quality Spa to reproduce their comment for the purpose of communicating it to the public online and creating communication and promotional materials for the Site. The Client authorizes Quality Spa to translate their comment into any language for the purpose of communicating it to the public online and reproducing it on its commercial and promotional materials. The right of adaptation also includes the right to make technically necessary modifications to exploit the comment in other formats. This license is granted for commercial and advertising use. It is granted for the entire duration of the rights, for exploitation in France and abroad.
The Client declares that they have the intellectual property and the necessary authorizations to publish their comment. The Client undertakes to intervene in any request from Quality Spa in any proceedings brought against the latter as a result of their comment and to guarantee it against any costs and judgments pronounced against them as a result, including any legal fees.
8.2.3 Deletion of personal space
Quality Spa reserves the right to delete the account of any Customer who violates these general terms and conditions, in particular when the Customer provides inaccurate, incomplete, false or fraudulent information, as well as when a Customer's personal space has remained inactive for at least one year. Said deletion will not constitute a fault on the part of Quality Spa or damage for the excluded Customer, who will not be able to claim any compensation for this reason.
This exclusion is without prejudice to the possibility for Quality Spa to take legal action against the Client, when the facts justify it.
9.1 Delivery costs
Delivery or provision costs will, in all cases, be indicated to the Customer before any payment and only apply to deliveries made in mainland France. Orders will be delivered to the address indicated by the Customer when ordering.
Delivery can be carried out by the transport company in charge of shipments or directly by Quality Spa. In the case of delivery with the Service Pack, this is understood to be only within French territory. The Customer will be responsible for the various costs for exceptional transport such as sea or air for the French Overseas Territories or Corsica, or for the right of way on specific bridges. A specific quote will be provided to the Customer when the Product is available. In the event of refusal by the Customer, the Product may be transported as close as possible to their home before any additional costs.
Delivery is made to the doorstep. The Customer must ensure that the packaging is large enough to accommodate the package. Quality Spa and the transport company cannot be held responsible if the delivery is made to the sidewalk.
Regarding the specific delivery of Swim Spas, in the case of delivery by special delivery without options, the delivery does not include unloading the Swim Spa. The Customer must provide the appropriate equipment to be able to drop off the Spa at their home. Quality Spa offers deliveries with crane trucks, forklifts, with simple removal or installation. These options must be planned at the time of ordering, with a quote made at your home.
The delivery costs indicated on the Site are in euros, all taxes included.
9.2 Delivery time
Orders are delivered within seven working days from the date of full payment by Quality Spa.
However, some products or order volumes may require a delivery time of more than seven working days. This will be expressly mentioned to the Customer when confirming the order.
9.3 Damaged package
In the event of delivery of a package that is clearly and visibly damaged, it is the Customer's responsibility to refuse it in order to benefit from the guarantee offered by the carrier. The Customer must also inform the seller without delay, so that a new package can be prepared for them and then shipped upon receipt of the damaged package in return. In such a case, the delivery times indicated above in these general conditions will no longer be applicable.
9.4 Request for cancellation of delivery and/or installation.
For any request to cancel delivery and/or installation of Spas, Swim Spas, Saunas or any large goods requiring significant organization in advance: In the event of a cancellation by the customer less than 72 hours before the scheduled date, their request will be taken into account, but all costs necessary for the proper execution of their delivery and/or installation will be invoiced again. Quality Spa will not bear any costs related to this request.
9.5 Lifting, crane or difficult access services
When the delivery of the product (spa, swim spa or any other equipment) requires the intervention of a third-party service provider for lifting or crane operations (e.g.: access at height, passage over a building, difficult terrain, etc.), Quality Spa acts exclusively as an intermediary, without exercising any direction or control over said service.
The Customer expressly acknowledges that: The intervention of a crane operator or any lifting service provider is subject to a prior technical study, in particular with regard to the accessibility of the location, the configuration of the land, neighborhood constraints and any administrative authorizations (roads, town hall, etc.);
Quality Spa is in no way responsible for the direct or indirect consequences of a particular lifting, crane or handling operation, in particular in the event of:
The Customer assumes full responsibility for the choice of the installation location and must ensure, under his sole responsibility, that the ground or infrastructure is suitable for receiving the spa and for the use of lifting equipment.
In the event that Quality Spa proposes a third-party service provider to carry out the lifting, it is understood that:
The Client remains entirely responsible for verifying the conditions of performance, the necessary insurance, and compliance with local regulations;
No guarantee can be demanded from Quality Spa concerning the progress, feasibility or safety of the operation.
By accepting the lifting service, the Client expressly releases Quality Spa from any civil, contractual or tortious liability relating to the performance or consequences of said service.
As part of its service, Quality Spa will be required to process the personal data of its Clients.

The data collected during the contractual relationship is subject to automated processing for the purpose of:
execute contractual commitments; contact Customers;
prevent any illicit or illegal activity; enforce the general conditions; initiate legal proceedings; verify the identity of Customers;

The data collected has a contractual relationship as its legal basis.
10.3.4 Data recipients
The data collected may only be viewed by Quality Spa within the limits strictly necessary for the execution of contractual commitments. This data, whether in individual or aggregated form, is never made freely viewable by a third-party natural person.
10.3.5 Duration of storage of personal data
The personal data collected is retained for the duration of the contractual relationship, and for the period during which Quality Spa may be held liable. After the retention period, Quality Spa undertakes to permanently delete the data of the persons concerned without keeping a copy.

Quality Spa directs its Clients to provide personal data strictly necessary for the execution of contractual commitments. Quality Spa undertakes to retain and process only data strictly necessary for its professional activities, and will delete any data received that is not useful for its activities as soon as possible.
10.4 Respect for rights
Quality Spa Customers have the following rights regarding their personal data, which they can exercise by writing to Quality Spa's postal address or by completing the online contact form.
10.4.1 Right to information, access and communication of data Quality Spa Customers have the possibility of accessing personal data concerning them.
Due to the security and confidentiality obligation in the processing of personal data incumbent on Quality Spa, requests will only be processed if Customers provide proof of their identity, in particular by producing a scan of their valid identity document (in the case of a request via the dedicated electronic form) or a signed photocopy of their valid identity document (in the case of a request sent in writing), both accompanied by the words "I certify on my honor that the copy of this identity document is a true copy of the original. 10.4.6 Response times

If Quality Spa is involved in a merger, sale of assets, financing transaction, liquidation or bankruptcy or in an acquisition of all or part of its business by another company, Customers consent to the data collected being transmitted by Quality Spa to this company and to this company carrying out the processing of personal data referred to in these General Conditions of Service in place of Quality Spa.
11.1 Nature of Quality Spa’s obligations
Quality Spa undertakes to take the necessary care and diligence to provide quality Products in accordance with the specifications of these General Conditions. Quality Spa is only liable for an obligation of means concerning the services covered by these General Conditions.
11.2 Force majeure – Customer fault
Quality Spa shall not be liable in the event of force majeure or fault of the Client, as defined in this article:
11.2.1 Force majeure
For the purposes of these general terms and conditions, any impediment, limitation or disruption of the Service due to fire, epidemic, explosion, earthquake, bandwidth fluctuations, failure attributable to the access provider, failure of transmission networks, collapse of installations, illicit or fraudulent use of passwords, codes or references provided to the Customer, computer hacking, a security breach attributable to the Site host or developers, flood, power outage, war, embargo, law, injunction, request or requirement of any government, requisition, strike, boycott, or other circumstances beyond the reasonable control of Quality Spa will be considered a case of force majeure against the Customer. In such circumstances, Quality Spa will be excused from the performance of its obligations to the extent of this impediment, limitation or disruption.
11.2.2 Customer Fault
Within the meaning of these General Conditions, any misuse of the Service, fault, negligence, omission or failure on the part of the Customer or its agents, failure to comply with the advice given by Quality Spa on its Site or owner's manual, any illicit disclosure or use of the Customer's password, codes and references, as well as the provision of erroneous information or the failure to update such information in the Customer's personal space, will be considered a fault of the Customer against the latter. The implementation of any technical process, such as robots or automatic requests, the implementation of which contravenes the letter or spirit of these general conditions of sale will also be considered a fault of the Customer.
11.3 Technical Issues – Hyperlinks
In the event of inability to access the Site due to technical problems of any kind, the Customer may not claim damages and may not claim any compensation. The unavailability, even prolonged and without any time limit, of one or more online services, cannot constitute a prejudice for Customers and cannot in any way give rise to the award of damages by Quality Spa.

The spas are intended for outdoor installation, if an indoor installation is envisaged, Quality Spa cannot be held responsible for any damage caused, water damage, leaks, electrical short circuits, unlocked drain valves, having damaged the interior of the home or premises. The photographs of the Products presented on the Site are a suggestion and have an indicative, non-contractual value. The photographs being a suggestion and having only an indicative value, the Customer is informed and accepts that the Product delivered may be different from the photograph. However, Quality Spa undertakes to make its best efforts, as an obligation of means and to the extent possible, to ensure that the Product delivered resembles as closely as possible the photograph of the chosen Product, in particular with regard to the shape, the dominant color, and subject to the price formula chosen by the Customer. There may therefore be differences compared to the illustrative photograph, but the Product delivered will be of equivalent quality and value. In the event of a substantial difference, the Customer will be informed and may modify or cancel their order.
11.5 Damages payable by Quality Spa
In the absence of any legal or regulatory provisions to the contrary, the liability of Quality Spa is limited to the direct, personal and certain damage suffered by the Customer, on its website, and linked to the failure in question. Quality Spa may under no circumstances be held liable for indirect damages such as, in particular, loss of data, commercial damages, loss of orders, damage to brand image, commercial disruption and loss of profits or customers. Similarly and within the same limits, the amount of damages payable by Quality Spa may not in any event exceed the price of the Product ordered.
11.6 Hypertext links and contents of the Site
The Contents of the Site are published for informational purposes only, without any guarantee of accuracy. Quality Spa cannot be held responsible under any circumstances for any omission, inaccuracy or any error contained in this information which would be the cause of direct or indirect damage caused to the Internet user.
11.7 Liability as host
The data, in particular comments, published on the Site by the Client are published under his/her own responsibility.
In this context, Quality Spa will benefit from the status of data host within the meaning of Article 6-I-2 of the Law for Confidence in the Digital Economy of June 21, 2004. In accordance with paragraph 3 of the same article, Quality Spa cannot be held civilly or criminally liable for these comments, unless, from the moment it became aware of the illicit activity or information, it acted promptly to remove this information or make access to it impossible.

12.2 Contractual protection of the Site Contents
The Internet user contractually undertakes with respect to Quality Spa not to use, reproduce or represent, in any way whatsoever, the Contents of the Site, whether or not they are protected by an intellectual property right, for any purpose other than that of reading them by a robot or a browser. 13.4 Entirety
The invalidity of one of the clauses of this contract shall not entail the invalidity of the other clauses of the contract or of the contract as a whole, which shall retain their full effect and scope. 13.5 Non-waiver

13.8 Abusive clauses
The provisions of these general conditions apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair clauses in contracts concluded between a professional and a consumer.
ORDER CANCELLATION METHOD IN THE EVENT OF A DISTANCE SALE TO A CUSTOMER (In-store or trade show/fair sales are not subject to this type of cancellation method)
In the case of distance selling, as defined by Article L. 221-1 of the Consumer Code, within fourteen days, including public holidays, from the order or purchase commitment, the Customer has the right to cancel by registered letter with acknowledgment of receipt. The purpose of these general conditions of use (known as " CGU ") is to provide a legal framework for the terms and conditions of provision of the site and services by Quality Spa and to define the conditions of access and use of the services by the "User ".
